Article 1 - Who We Are

Maison Arca is a brand operated by Denim Pro SPRL, a company incorporated in Belgium with company number BE 0836.467.226, headquartered at Avenue Louise 539, 1050 Brussels, Belgium.

This agreement applies to the website maisonarca.com and governs all purchases made through it. For any questions or support, you can reach us at contact@maisonarca.com.

Any reference to "Maison Arca," "we," "us," or "our" throughout this document refers to Denim Pro SPRL.

Article 2 - Applicability

These Terms and Conditions apply to everyone who visits or shops on our website. By browsing or placing an order, you confirm that you have read and accepted them.

We may update these terms from time to time. The version in effect at the moment you place your order is the one that applies to that purchase.

Maison Arca operates and delivers its services from Belgium.

Article 3 - Who Can Order

You must be at least 16 years old and legally able to enter into a contract to place an order. If you are under 16, a parent or legal guardian must complete the purchase on your behalf and will be bound by these terms.

We reserve the right to decline any order if we have reason to believe it is placed in bad faith or involves misuse of our services.

Article 4 - Order Changes and Cancellations

If a product in your order becomes unavailable after you have placed it, we will notify you by email and either partially or fully cancel the affected items. If payment has already been taken, we will refund you promptly.

We may also cancel an order if the shipping address provided is incomplete, unclear, or undeliverable. A refund will be issued if payment was already collected.

Once you have completed your purchase, you cannot cancel or modify the order yourself. You can still return it under Article 9. If you received the wrong item, please contact us at contact@maisonarca.com.

Article 5 - Pricing

All prices shown on our website are listed in Euros and include applicable VAT for deliveries within the European Union, unless stated otherwise. Shipping costs are not included in the product price and are shown at checkout before you pay.

The price you see at the time of placing your order is the price that applies to your purchase. Price changes do not affect orders already confirmed.

Discounts and promotional offers apply to product prices only, not to shipping fees. Unless stated otherwise, discount codes cannot be combined with each other.

All products remain our property until full payment has been received.

If we discover an obvious pricing error after your order has been placed, we will contact you to offer the choice of proceeding at the corrected price or cancelling the order for a full refund. If we cannot reach you, the order will be cancelled and refunded.

Article 6 - Payment

All purchases must be paid online using one of the methods available at checkout. Your payment is processed at the time of purchase. If your bank or payment provider declines the transaction, the order will not go through.

Payments are handled by secure third-party payment processors. We never see, access, or store your card details or banking credentials.

We may refuse to process an order from anyone who has an outstanding dispute with us, an unpaid previous order, or whose behaviour suggests fraudulent intent.

Article 7 - Placing an Order

Our catalogue reflects what is available at the time you visit the site. Availability may change without prior notice.

We describe and photograph all products as faithfully as possible, but minor differences in colour or texture may occur due to screen settings or photography.

Once your payment goes through, your order is confirmed. You will receive an order confirmation by email, followed by a second notification when your package is shipped.

Article 8 - Delivery

Delivery costs, timeframes, and available shipping methods depend on your location and are shown at checkout before you pay. For more information, please see our Shipping Policy.

We deliver to the address you provide when placing your order. If an order contains multiple items, we may ship them separately at no extra cost to you.

If your package is lost in transit, we will either reship the product at our expense (if still in stock) or issue a full refund including any shipping fees you paid.

Risk of loss or damage transfers to you once the package has been delivered.

Customers ordering from outside the European Union may be subject to customs duties or import taxes imposed by their local authorities. These fees are not included in our prices and are the customer's responsibility.

Article 9 - Returns and Right of Withdrawal

Under European consumer protection rules, you have the right to withdraw from your purchase within 14 calendar days of receiving it, without giving a reason. This applies to all items, including items bought on sale.

To start a return, email us at contact@maisonarca.com within 14 days of delivery with your order number and the items you would like to send back. You must ship the items back within 14 days of notifying us.

Items should be unworn, unwashed, unaltered, and returned with all tags attached. If an item has been handled beyond what is needed to try it on, we may reduce the refund to reflect the loss in value.

The cost of return shipping is your responsibility.

We refund you within 14 days of receiving your withdrawal request, to your original payment method. We may wait until we have received the returned items before issuing the refund. If you return your full order, the standard delivery cost you paid is also refunded.

Article 10 - Legal Guarantee

All our products are inspected before shipping and are covered by the 2-year legal guarantee of conformity under Belgian and EU law.

If you receive something that is damaged or defective, contact us at contact@maisonarca.com, ideally within 48 hours of delivery, with photos. We will replace the item or refund you in full, at no cost to you.

This does not cover damage resulting from misuse, negligence, or normal wear over time.

Article 11 - Intellectual Property

Everything on our website, from product photography and brand imagery to written content, logos, and page design, belongs to Maison Arca and is protected under intellectual property law. You may not reproduce, distribute, or reuse any of this content without our written permission.

Article 12 - Limitation of Liability

We are not responsible for technical issues, viruses, or any harm to your devices that may result from using our website.

We are not liable for delays or failures in delivery caused by events outside our control, including carrier disruptions, natural disasters, public health emergencies, or interruptions to postal and communications infrastructure.

Nothing in these terms limits your rights as a consumer under mandatory law.

Article 13 - Your Personal Data

We handle your personal information in line with the GDPR and our Privacy Policy.

Article 14 - Applicable Law

This agreement is governed by Belgian law. If you live in another EU country, you keep the protection of the mandatory consumer laws of your country.

If a dispute arises that we cannot resolve together, you can contact the Belgian Consumer Mediation Service (mediationconsommateur.be). The competent courts in Belgium will otherwise have jurisdiction.

Article 15 - Updates to These Terms

We may revise these Terms at any time to reflect changes in our operations or new legal requirements. Updated terms apply to orders placed after their publication. If any clause is found to be invalid, the rest of the agreement remains in effect.
