GENERAL TERMS AND CONDITIONS

 

Article 1 - Who We Are

 

Maison Arca is a brand operated by Denim Pro SPRL, a company incorporated in Belgium under company number BE 0836.467.226, with its registered office at Avenue Louise 539, 1050 Brussels. VAT number: BE 0836.467.226. This agreement applies to the website maisonarca.com and governs all purchases made through it. For any question or assistance, you can contact us at contact@maisonarca.com. Any reference to "Maison Arca", "we", "our" or "us" throughout this document refers to Denim Pro SPRL.

 

Article 2 - Applicability

 

These General Terms and Conditions apply to anyone who visits or makes a purchase on our site. By browsing or placing an order, you confirm that you have read and accepted these terms. We may update these terms from time to time. The version in force at the moment you place your order is the one that applies to that purchase. If any clause is held to be unenforceable, all other clauses remain valid. In the absence of specific provisions in these terms, Belgian law applies. Maison Arca operates and provides its services from Belgium. All contracts concluded through the site are deemed to be performed in Belgium.

 

Article 3 - Who Can Order

 

You must be at least 16 years old and legally able to enter into a contract in order to place an order. If you are under 16 or lack legal capacity, a parent or legal guardian must make the purchase on your behalf and will be bound by these terms. Before completing your purchase, you will be asked to confirm that you accept these General Terms and Conditions by selecting "I accept the General Terms and Conditions". No order can be completed without this step. We reserve the right to refuse any order if we have reason to believe it has been placed in bad faith or involves a misuse of our services.

 

Article 4 - Order Changes and Cancellations

 

If a product in your order becomes unavailable after it has been placed, we will inform you by email and will cancel the affected items in part or in full. If payment has already been taken, we will initiate a refund as soon as possible. Refund processing times depend on the payment method chosen. We may also cancel an order if the delivery address provided is incomplete, unclear or non-existent. A refund will be issued if payment has already been collected. Once your purchase has been made, you cannot cancel or change the order yourself. If you have received an incorrect item or need a different size, please contact us at contact@maisonarca.com and we will do our best to help you.

 

Article 5 - Pricing

 

All prices displayed on our site are in Euros and include applicable VAT, unless stated otherwise. Delivery charges are not included in the product price and are calculated separately at checkout. The price you see at the moment you place your order is the price that applies to your purchase. We may adjust our prices or shipping rates at any time, but changes will not affect orders already confirmed. Discounts and promotional offers apply to product prices only, not to delivery charges. All products remain our property until full payment has been received and confirmed. If we discover a pricing error after your order has been placed, we will contact you to give you the choice of proceeding at the corrected price or cancelling the order for a full refund. If we are unable to reach you, the order will be cancelled and refunded.

 

Article 6 - Payment

 

All purchases must be paid online using one of the methods available at checkout. Your payment will be processed at the time of purchase. If your bank or payment provider declines the transaction, the order will not be processed. By submitting your payment, you confirm that you are authorised to use the selected payment method and that sufficient funds are available. We use secure third-party payment processors to handle all transactions. We never see, access or store your card details or banking data. We may refuse to process an order from anyone who has an ongoing dispute with us, an earlier unpaid order, or whose behaviour suggests fraudulent intent.

 

Article 7 - Placing an Order

 

Our product catalogue reflects what is available at the time you visit the site. Availability may change without notice. We describe and photograph all products as faithfully as possible, but minor differences in colour or texture may occur due to screen settings or photography. Such differences do not constitute grounds for complaint or return. Once your payment has been made, your order is confirmed and final. You will receive an order confirmation by email, followed by a second notification when your parcel is dispatched. The records kept in our systems, or those of our hosting and payment partners, serve as the official documentation of all orders and communications between us.

 

Article 8 - Delivery

 

Delivery charges, timeframes and available shipping methods depend on your location and are displayed at checkout before you pay. For more information, please see our Shipping Policy page. We deliver to the address you provide when placing your order. If an order contains several items, we may ship them separately at no additional cost to you. If your parcel is lost in transit, we will resend it at our expense (if it is still in stock) or issue a full refund including the shipping charges you paid. Once a parcel has been delivered to your address, all risk of loss or damage passes to you. Customers ordering from outside the European Union may be subject to customs duties or import taxes imposed by their local authorities. These charges are not included in our prices and are the customer's responsibility.

 

Article 9 - Returns and Right of Withdrawal

 

In accordance with European consumer protection rules, you have the right to return any item within 14 calendar days of receiving it, without having to give a reason. To start a return, email us at contact@maisonarca.com within 14 days of delivery with your order number and a description of what you wish to return. You must send the item(s) back to us within 14 days of your notification. Everything must be in its original, unused condition: unworn, unwashed, unaltered, with all tags still attached. We will not accept returns showing signs of use or missing tags. Return shipping costs are at your expense. If you need a different size of the same product, we offer free exchanges subject to stock availability. Once we receive and inspect your return, we will refund the purchase price to your original payment method within 14 business days. The refund will never exceed the amount you originally paid. Article 10 - Product Warranty

 

All our products are manufactured to high standards and inspected before dispatch. We guarantee that no item leaves our facilities with hidden defects that would make it unsafe or unusable. If you receive something damaged or faulty, contact us at contact@maisonarca.com within 48 hours of delivery. Include photos so that we can assess the issue. We will replace the item or refund you in full, at no cost. This warranty does not cover damage resulting from misuse, neglect or normal wear and tear over time. Nor does it override any additional rights you may have under your national consumer protection laws.

 

Article 11 - Intellectual Property

 

Everything you see on our site, from product photography and brand imagery to written content, logos and page design, belongs to Maison Arca and is protected by intellectual property law. You may not reproduce, distribute or reuse this content without our written permission. We will take legal action against any unauthorised use.

 

Article 12 - Limitation of Liability

 

We are not responsible for technical issues, viruses or any harm to your devices that may result from using our site. Nor are we responsible for delays or delivery failures caused by events beyond our control, including but not limited to carrier disruptions, natural disasters, public health emergencies, or interruptions to postal and communication infrastructure. In any situation where we are held liable, our liability is limited to the total amount you paid for the specific order in question.

 

Article 13 - Your Personal Data

Article 14 - Governing Law

 

This agreement is governed by Belgian law. If a dispute arises that we cannot resolve together, the competent courts in Belgium will have jurisdiction. You may also file a complaint through the EU online dispute resolution platform at https://ec.europa.eu/consumers/odr.

 

Article 15 - Updates to These Terms

 

We may revise these General Terms and Conditions at any time to reflect changes in our operations or to comply with new legal requirements. The updated terms will be published on our site and will apply to all orders placed after the date of publication. We also reserve the right to change the layout, features or content of our site at any time without notice. If any clause in these terms is found to be invalid or unenforceable by a court, the remainder of the agreement remains in full force.
